DIVERGENT MEANING AND ITS IMPACT ON THE JURISPRUDENTIAL REASONING: AHKAM AL-QUR'AN BY IBN AL-FARAS AS A MODEL: A THEORETICAL AND PRACTICAL STUDY

Abstract

The research aims to clarify the most important indications that scholars frequently employ and implement in reasoning. It is contradiction or what is known in the books of fundamentalist scholars as "Divergent meaning". It began with the introduction that includes the importance and the objectives of the research and indicated the scientific problem, as well as, the research methods. This research divided into two parts; theoretical and practical. The first part included the definition of the contradiction or what is Ibn AL-Faras called "Divergent meaning". It presented the different names of contradiction and its terminology in the fundamentalists and explain the term used by Ibn AL-Faras. It also discuss the authenticity of contradiction, elaborated the position of Ibn Al-Faras and dealt with the conditions of the concept of contradiction and Ibn Al-Faras implementation of it. The second part highlighted the impact of "Divergent meaning" in the reasoning of Ibn AL-Faras. In the conclusion, I mentioned the findings and the most important ones show that Ibn Al-Faras was assign of contradiction and its impact appear in reasoning of number of legal rulings and declared in some reasoning by "Divergent meaning", which the judgment was deduced, and in some of them, he was satisfied with the deduction of the judgment. Ibn Al -Faras used to call the contradiction by the term "Divergent meaning" and benefited from an indication of all kinds of contradiction. Ibn Al-Faras applied the conditions set by the fundamentalists to accept the reasoning with the concept of the contradiction, and rejected the reasoning was by those who used this concept without implementing its conditions and the rules of using it.
